Represented the Defendants in civil proceedings involving claims arising from alleged contractual obligations, guarantees and outstanding payments, together with claims seeking the cancellation of a sale agreement and recovery of possession of immovable property. Successfully opposed the claimant’s application for interim injunctive relief seeking to restrain the Defendants from disposing of their assets in Cyprus and abroad. The Court dismissed the application, thereby preserving the Defendants’ unrestricted ownership and control of their assets pending the determination of the action.

Experience
Was part of our firm’s team that prepared an expert legal opinion on Cypriot law and local safety standards for use in a personal injury claim before the English Courts that involved a hotel accident in Cyprus. The report analysed the applicable Cypriot legal framework, regulatory requirements and industry standards governing hotels’ duties of care, including maintenance, inspections, safety procedures and warning obligations.
Represented the defendant in proceedings arising from a construction agreement relating to the completion of a high-value residential development, in which the claimants sought to recover a substantial sum allegedly due under an interim payment certificate. During the course of the proceedings, Nicoletta successfully opposed the claimants’ application for an interim injunction seeking to prevent the defendant from selling, transferring, charging or otherwise disposing of the property pending the final determination of the action.
Was part of the team of our firm that successfully negotiated a settlement for a €4 million dispute under which the clients received immovable property and transfer of funds as part of the settlement.
