Michael Kyprianou Law Firm at the IBA Asset Recovery 2023 Conference

topic

Marina Hadjisoteriou, Partner and Head of the firm’s Limassol Dispute Resolution Department, represented the firm at the inaugural Asset Recovery Conference hosted by the International Bar Association on December 06th – 08th 2023, in Vienna.

The conference brought together legal professionals specialising in asset tracing and recovery, anti-corruption, insolvency, litigation, and criminal law from around the world, discussing and sharing insights on topics such as multifaceted asset recovery strategies, the use of innovative techniques, and evidence gathering in privacy-driven or complex jurisdictions.

The various sessions provided for an opportunity to, amongst other, examine the rights and role of victims in asset recovery and third-party interference, and exchange global expertise on tracing, recovering and preserving unique and difficult classes of assets and how to approach recovery of assets which, from a procedural, logistical or practical perspective may be challenging to trace, attach or to recover against, such as intellectual property rights and specific commodities, or concern digital assets for which there is still little expertise.

Dedicated panel discussions also focused on the feasibility and desirability of preparing an international model law, currently discussed at UNCITRAL level, to assist practitioners in making recoveries for plaintiffs and creditors, and the implications on client representation and dispute resolution in reference to monetising awards and judgments against sanctioned states and entities amidst the recent waves of sanctions.
