This second Tylney session of the month was held as part of the LCIA’s biannual Tylney Hall symposia. The participants explored the impact of the pandemic on the arbitral process and the ways in which arbitration has evolved to adapt to the requirements of uncertain times. More specifically, the participants discussed what happens when one of the parties objects to a virtual hearing or one party does not wish to turn their camera on during the virtual hearing. Additionally, the need for electronic signatures on arbitral awards and associated risks was also discussed. Finally, the participants considered what the new normal will be after the pandemic comes to an end, taking into consideration ESG (environmental, social and governance) concerns.
