Long-awaited amendments to the Trademarks Law (Cap. 268) in Cyprus

The proposed amendments have been passed into law on 5 June 2020 and published in the Official Gazette of the Republic of Cyprus on 12 June 2020, transposing the European Union Trademark Directive 2015/2436 into national law. The Trademarks’ (Amendment) Law of 2020 will in essence bring national trademark legislation in alignment with European Union legislation. Some notable changes include, inter alia, the following:

  • Abolition of the graphical representation requirement (Article 4)
  • Ease of submission of non–traditional trademarks (Article 4(b))
  • Α multi-class system for trademarks (Article 26(4))
  • Extension of the opposition period from 2 to 3 months (Article 28(1))
  • If the parties reach an amicable settlement prior to the publication of the opposition judgment, the opposition will be archived without a judgment being made (Article 30(3))
  • Increase of initial 7-year period of protection to 10 years and subsequent renewals for 10-year periods (Article 34(1))
  • Reduced fees for electronic submissions of applications (Article 62(2)b)
  • Abolition of the need to submit a Power of Attorney
  • One total fee for the registration
