Amendment of Prevention and Counteraction for the Legality of Income Derived from Illegal Activities Law

In March 2016 the House of Representatives voted an amendment Law that adjusts Laws of 2007 until 2014 for the Prevention and counteraction of the legality of income derived from illegal activities.

The primary objective of said Law is to criminalize the legality of income derived from serious criminal offences and the provision for forfeiture and confiscation.

Some of the significant amendments of said Law are:

  • Victim or plaintiff has the right to claim compensations in relation to losses or damages suffered during the commission of a crime with civil action against the person on which a decree of confiscation is issued.
  • Establishment of special Fund to hold the deposits resulting from the sale of confiscated assets for the benefit of the State after implementation of the issued decree.
  • A decree of confiscation may be issued against the person facing criminal proceedings which can lead to conviction if the defendant was able to be present at trial but the hearing was cancelled due to illness or the because defendant fled.
